Mooboo is a service provided by Attra Limited, a company incorporated in New Zealand ("we", "us", "our"). These Terms set out the rules for using Mooboo. By creating an account, you agree to them.

Key things to know before you accept: your subscription tokens reset monthly and unused ones don't carry over (see Subscriptions); we run quality checks on generated books but can't guarantee a perfect result (see Your Books); your books are for personal, non-commercial use — not for resale (see Your Books); printed books are custom-made and can't be refunded, though we'll replace one that's faulty through no fault of your own (see Printed Books); we send your content to third-party providers to generate your book (see Third-Party Services); and our liability to you is limited to the fees you've paid us (see Liability).
You must be at least 18 years old to create a Mooboo account. By signing up, you confirm that you are. Mooboo is for parents, guardians and gift-givers — it is not directed at children, and children must not create accounts or use the service directly.
We may require you to verify your identity or age through a third-party verification provider before granting or continuing your access to Mooboo. If you don't complete verification when we require it, we may withhold or suspend access to your account.
Keep your password secure and don't share it. You're responsible for everything that happens under your account. Let us know at support@mooboo.app straight away if you think someone has accessed your account without permission.
Mooboo uses tokens to generate books — one token per book. Tokens come with a monthly subscription. The plans available, their prices, and their monthly token allowances are shown on our platform. Where we offer a free tier, its token allowance and any conditions on it will also be shown on our platform, and we may change or withdraw it at any time.
Your subscription renews automatically each month. Your token allowance resets to your plan's full amount at the start of each billing period — unused tokens don't carry over. You can upgrade, downgrade or cancel your subscription at any time through your account. Cancellation takes effect at the end of your current billing period; you keep access to your remaining tokens until then.
If a payment fails, we may suspend your access while our payment provider retries. If payment isn't recovered, we may cancel your account.
Payments are processed by Stripe. By subscribing, you agree to Stripe's terms (stripe.com) and confirm you're the authorised holder of the payment method you use. You're responsible for any applicable taxes on your subscription fees.
When you upload a photo of a child, you confirm that you are that child's parent or legal guardian, or that you have the express permission of their parent or legal guardian to upload the photo(s) and use them to create a book. You must not upload a photo of a child without that authority.
Reference photos are not stored in our database. They're held in memory during processing only, then discarded. See our Privacy Policy and the Third-Party Services section below for details of how photos are handled.
You may use Mooboo only for lawful purposes and in accordance with these Terms. You must not:
We may impose fair-use limits if we see excessive or abusive usage patterns, and we may refuse any request we consider inappropriate or unlawful.
Your inputs: You keep ownership of any photos, story prompts and other content you submit to Mooboo. By submitting them — including anything you type into a story brief, character description or theme — you confirm you have the right to do so, and that it doesn't infringe anyone else's rights, including intellectual property rights.
Generated books: Ownership of your generated books vests in you immediately on creation, on every plan, including any free tier.
Permitted use: Your generated books are for personal, non-commercial use — reading them, sharing them with family, printing them for yourself. You may not sell or commercialise them without our written agreement — this includes reselling copies, listing them for sale, using them as merchandise, or republishing them commercially in any form.
What we do with your content: We use your inputs only to generate your book and display it to you. We don't use your content to train AI models. We don't use it for any other purpose without your consent.
AI limitations: Mooboo uses AI to create illustrated storybooks. Illustrations may not precisely match your reference photo — the AI produces a stylised interpretation in the art style you choose. Character appearance may vary slightly from page to page. Generated text may occasionally contain minor errors. We run quality checks, but we can't guarantee a perfect result. Generated content may occasionally resemble existing characters, brands or other third-party works despite our efforts, and we don't warrant that it won't. Generated books are provided as-is, and you should review yours before sharing or printing it.
Non-uniqueness: Other users may receive visually similar books. Your ownership doesn't extend to another user's independently generated book.
You may be able to order a physical printed copy of a book you've created, for a separate one-off price shown at the time of order. Printed books are produced for us by a third-party print partner (see Third-Party Services). The personal, non-commercial use restriction in Your Books applies to printed copies too — ordering a printed copy doesn't change it, and copies must not be ordered for resale.
Printed books are custom-made — no refunds. Each printed book is produced specifically around your photos and your story and can't be resold to anyone else. Because of this, printed books are exempt from any cancellation or cooling-off right that would otherwise apply to a distance sale, and we don't offer refunds on them.
Review before you print. Before your order is placed, you'll be asked to confirm you've reviewed your digital book and are happy to print it as it is. Once you confirm this, we treat illustration style, anatomy, character consistency, text content, colour and composition as choices you've approved — these are not treated as faults, and a change of mind after ordering isn't a fault either.
What is a fault. A printed book is faulty if the physical object itself is defective in a way you could not have seen or approved beforehand — for example, pages bound out of order, upside down, missing or duplicated; pages badly mis-trimmed; visible printing defects such as smearing or banding; a warped or delaminating cover; the wrong book or specification altogether; or a copy damaged or lost in transit.
Remedy for a fault: free replacement. If your printed book is faulty, tell us within 21 days of delivery at orders@mooboo.app with photos showing the fault, and we'll arrange a free replacement. We don't offer cash refunds on printed books, including for faulty ones — a replacement copy is the remedy. This doesn't affect any right you have under consumer protection law in your country that we can't lawfully exclude.
Delivery. Delivery timeframes we show you are estimates covering production and shipping — not guaranteed dates. Risk in a printed book passes to you on delivery, not on dispatch; a copy lost or damaged before it reaches you is our responsibility and is covered above. You're responsible for entering an accurate delivery address at checkout. If a parcel is refused, unclaimed, or undeliverable because of an address you entered incorrectly, we're not able to offer a free replacement.
Import duties and taxes. Depending on the destination, import duties, customs charges or local taxes may apply — these aren't included in the price you pay, and are the recipient's responsibility. Once you select your delivery destination on the order page, we'll show you a notice if this may apply, before you continue to payment.
Books are private by default. Where we offer a sharing feature, enabling sharing on a book is your active choice to make content featuring your child visible to others — and by doing so you confirm that you have authority to do so.
Where we offer a referral programme, its terms — including any token or other reward — will be set out on our platform.
We own all intellectual property in Mooboo — its look, software, trademarks and content. Nothing in these Terms gives you any rights in our platform beyond the right to use it as described here. We may use any feedback you give us to improve Mooboo without any obligation to compensate you.
Third-party rights. We may refuse to generate, or remove, content that we reasonably believe infringes a third party's intellectual property or other rights, and may suspend or terminate an account for repeated or serious breaches (see Suspension and Termination). If you're a rights holder and believe a book generated through Mooboo infringes your rights, contact us at hello@mooboo.app with details and we'll investigate.
Your responsibility for what you generate. You're responsible for any request you submit to Mooboo, including any story brief, character description, or reference material. To the extent permitted by law, you agree to cover any losses, costs or claims we reasonably incur as a direct result of your deliberate breach of the Acceptable Use rule against requesting well-known characters, brands or logos you don't hold the rights to — this doesn't apply to an innocent mistake, or to anything arising from how Mooboo's AI actually generates content rather than from what you asked for.
Delivering Mooboo requires us to send your information to third-party providers, including:
These providers don't use your content to train their AI models, and retain it only as needed to perform their function for us. By using Mooboo, you authorise us to transfer your personal information to these and our other providers as needed to deliver the service. See our Privacy Policy for the complete, current list of providers we use, what each is used for, and where they're located — it's the source of truth for this, kept up to date as our providers change.
Nothing in these Terms limits any rights you have under the New Zealand Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other applicable consumer protection laws in your country. Where those laws apply and our service — including a printed book — isn't of acceptable quality, you may be entitled to a remedy. See Printed Books above for how we handle faults in physical orders specifically.
To the maximum extent permitted by law, we're not liable for loss caused by issues with your own device or internet connection, or by someone else using your account.
Neither of us is liable to the other for indirect or consequential losses — things like lost profits, lost data, or loss of goodwill. Our total liability to you for any claim is limited to the fees you've paid us in the 12 months before the claim. If you've paid nothing, this clause doesn't create a cap — our liability is whatever the law says it is.
Nothing here excludes liability for fraud, death or personal injury caused by our negligence, or any other liability that can't legally be excluded.
If you use Mooboo through an iOS app from the Apple App Store: these Terms are between you and us — Apple is not a party and has no responsibility for Mooboo or its content. Apple has no obligation to provide support for our app. If our app fails to meet any applicable warranty, you may notify Apple for a refund of the purchase price; Apple has no other warranty obligations. Apple is not responsible for any product liability, regulatory, or consumer protection claims relating to our app, or for any third-party IP claims against it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you're not in a US-embargoed country and not on a US Government restricted-parties list.
We may suspend or terminate your account if you breach these Terms, fail to pay subscription fees, or if we have reason to believe your account has been compromised. For most breaches we'll give you 14 days to fix things before terminating — but we may act immediately for serious or irremedial breaches (particularly breaches of the Acceptable Use section).
You can close your account at any time through your account settings. If you're on a subscription, it runs to the end of your billing period. If we materially breach these Terms and don't fix it within 14 days of you telling us, you may terminate and we'll refund any prepaid fees for the unused period.
On termination, your access ends and your remaining token balance is forfeited.
Changes to these Terms: We may update these Terms. Where a change materially affects your rights, we'll give you reasonable advance notice. If you continue using Mooboo after that notice, you agree to the updated Terms. If you don't agree, you can close your account before the change takes effect.
Governing law: These Terms are governed by New Zealand law. New Zealand courts have jurisdiction over disputes, subject to the dispute resolution process below.
Disputes: If we have a dispute, we'll first try to resolve it by talking directly. If that doesn't work: if you're based in New Zealand, either party may refer it to mediation through the NZDRC (nzdrc.co.nz); if you're not based in New Zealand, to arbitration through the NZIAC in Auckland (nziac.com). Either of us may seek urgent court relief at any time.
Marketing: We may send you service communications about your account and books. Where you've opted in, we may also send marketing updates — you can unsubscribe at any time using the link in any such email.
Assignment: You can't transfer your account or these Terms without our written consent. We may transfer our rights, for example in a business sale.
Force majeure: We're not liable for delays or failures caused by circumstances beyond our reasonable control.
No partnership: These Terms don't create a partnership, employment or agency relationship between us.
Notices: Send notices to us at hello@mooboo.app. We'll send notices to the email address on your account.
Survival: The sections on Your Books, Printed Books, Third-Party Services, Liability, and Termination survive the end of these Terms.
